This intermediate-level program examines the use of attorney opinion letters in the context of commercial real estate closings where a “closing opinion” is required by a lender. The course defines applicable terms and issues, identifies Florida-specific resources on the customary practice surrounding such opinions in the state, and uses a hypothetical commercial real estate transaction and a sample letter to illustrate key points. The course also considers the ethics of giving this type of opinion and addresses liability concerns for the opinion giver.
